Everyone living in the Birch Pointe community, whether owner or renter, is expected to comply with this Code of Conduct. Be a good neighbor and adhere to these rules.
Desired Conduct Consists Of:
- Keeping your balcony clean and free of debris.
- Keeping your balcony deck-drain clear.
- Disposing of your pet’s waste in the bags and receptacles provided.
- Inspecting (or hiring a contractor to inspect) your unit’s heating and air conditioning systems annually.
- Maintaining cleanliness of your dryer-vent ductwork to reduce the risk of fire.
- Maintaining screens on all of your windows in good working order.
- Obeying the community-wide 10 mph speed limit.
- Disposing of trash in dumpsters using sealed plastic bags. Under no circumstances may you leave trash next to the dumpster; simply find another if that one is full.
- Utilizing the recycling bins. Break down cardboard boxes to save room.
- Reporting suspicious activity to the police. Follow up with a call to any board member.
Prohibited Conduct Is Defined As:
- Smoking anything in indoor common spaces.
- Allowing smoke from your unit to enter a common area or another unit. Doing so may lead to fines and/or legal action by the board, or the affected owner(s).
- Conducting illegal activities in your unit or on community premises. Violations can and should be reported to police by any owner or board member.
- Using gas, charcoal, or open-fire grills. **This constitutes a New Castle County Fire Code violation** Electric grills are permitted.
- Leaving your building entrance door ajar for extended periods. You may prop the door open while moving items in and out of the building.
- Having more than two (2) vehicles per unit.
- Parking commercial vehicles on the premises, even if owned by the resident.
- Your guests parking in spaces marked RESIDENT.
- Leaving your abandoned, unlicensed, or unsightly vehicle anywhere in the community. This includes vehicles with excessive rust, missing body parts, flat tires, etc. Abandoned or unlicensed vehicles are subject to towing at your expense.
- Parking your car in a disabled-only spot without the proper hang-tag. This is subject to immediate towing at your expense.
- Parking your car in a fire zone, or in areas that block the dumpsters. This is subject to immediate towing at your expense.
- Failing to pick up after your pet. Doing so creates a health hazard for residents, and detracts from the overall appearance of our community.
- Allowing your pet outdoors without a leash. New Castle County Ordinance requires pets to be on a leash at all times while they are in public spaces.
- Renters having pets. Renters are not permitted to have pets.
- Creating excessive noise anytime. This includes music, televisions, operating appliances during nighttime hours, pets, parties, etc. New Castle County Police will handle noise complaints.
- Disposing of trash or cigarette butts on community property.
- Disposing of large items in the dumpster. Contact any board member to arrange for pickup of your items.
- Using your fireplace as a primary source of heat.
- Using your fireplace after the chimney has been capped. This could lead to a devastating fire. You will be held responsible if determined to be at fault.
- Entering your unit via the balcony if your balcony has a solid wall.
Violations are subject to fines by the Birch Pointe Condominium Association. Be courteous and respectful to your fellow residents.
