Every person living in the Birch Pointe community, whether owner or renter, is expected to comply with the provisions of this Code of Conduct. Be a good neighbor and citizen by following these rules.

Desired Conduct

• Keep all debris off balcony decks. This includes, but is not limited to: firewood, paper, trash/trash receptacles, ladders, indoor furniture, rugs, clothing and pet carriers.
• Keep flower pots and decorative ornaments, etc., off the balcony ledges (if applicable).
• Keep deck drains clear of debris, ice or snow in the winter (if applicable).
• Pick up after and dispose of pet waste at all times.
• Inspect or have inspected heating and air conditioning systems annually for leaks. Maintain dryer vents to prevent fires.
• Maintain screens on all windows.
• Obey the posted 10MPH speed limit on all community roads.
• Dispose of trash inside dumpsters in closed plastic bags. Under no circumstances should you leave trash next to the dumpster; find another dumpster in the event that one is full.
• Report any suspicious activity to the police immediately. Follow up with a call to the property manager.

Undesired Conduct

• Smoking of any kind in the hallways is never permitted. Smoking inside your unit must be controlled in such a way that smoke cannot penetrate into the common area or into other units. Failure to comply with this can and will lead to fines and/or legal action by owners.
• Illegal activities inside your unit or on community premises. Violaters are subject to being reported to the authorities immediately by owners or by the property manager.
• Use of gas, charcoal or open fire grills. This constitutes a NCCo Fire Code violation. Electric grills are permitted.
• Prop open or leave building entrance door ajar for extended periods. You may prop them open while moving heavy objects in and out of the building.
• Have more than two (2) vehicles per unit. Commercial vehicles owned by residents are not permitted anywhere on the premises. Guests are permitted to park throughout the community where space is available.
• Unsightly vehicles are not permitted throughout the community (this includes vehicles with excessive rust, missing body parts, etc.). Abandoned or unlicensed vehicles are subject to towing at the owner’s expense.
• Parking in handicapped spots without proper authorization is subject to immediate towing at the owner’s expense.
• Parking in fire zones or in areas that block the dumpsters is subject to immediate towing at the owner’s expense.
• Walking of pets anywhere without cleaning up after your pets. It is never acceptable not to clean after your animal.
• Create excessive noise at any time. This includes loud music/televisions, running appliances during nighttime hours, pets, parties, etc. The police will be called to handle noise complaints.
• Disposal of trash or cigarette butts on community property.
• Disposal of large trash items in the dumpster is not permitted. Contact the property manager to arrange for separate pickup of such items.
• Never use your fireplace as a primary heat source. Never use your fireplace if your exhaust has been capped. This may lead to a devastating fire and you will be held responsible if found in violation.
• Refrain from entering your unit from the balcony if you have a glound floor unit with a solid balcony wall.

Violations are subject to fines by the Birch Pointe Condominium Association. Be courteous and respectful to your fellow residents.
